Terms of Service

1. Agreeing to these terms

By using this website, joining the waitlist, or using NoteGage, you agree to these terms. If you don't agree, don't use the service.

You must be at least 18 years old to use NoteGage.

2. Who we are

NoteGage (“we,” “us”) operates this website and service. Reach us at hello@notegage.com.

3. What NoteGage is

NoteGage is software that analyses mortgage-note listings and publicly listed loan data. It scores a note deal from 0 to 100 using a deterministic rubric, and cross-checks a seller's stated claims against independent public records, flagging fields where the two disagree.

NoteGage is in early access. Features may change, and some described on this site may not be available yet.

4. This is not professional advice

NoteGage produces analysis of publicly listed loan data. It is not legal, tax, or investment advice, and does not replace title work, a collateral-file review, or a licensed appraisal.

If you have an account, you're responsible for keeping your login secure. Tell us at hello@notegage.com if you think it's been compromised.

6. What you agree not to do

We can suspend or end your access if you do any of these.

7. Ownership

We own the NoteGage name, website, software, scoring rubric, and methodology.

You keep ownership of anything you upload or submit. By submitting it, you give us permission to use it as needed to provide the service to you.

You can use our output for your own business purposes. You can't republish it, resell it, or present it as your own product.

8. No warranties

The service is provided “as is,” without warranties of any kind.

We specifically don't warrant the accuracy, completeness, timeliness, or reliability of any data, score, valuation, public record, or analysis the service produces. Public records, listing data, and third-party sources may be inaccurate, incomplete, or out of date.

We don't warrant that the service will be uninterrupted or error-free.

Some states don't allow certain warranty exclusions, so parts of this may not apply to you.

10. Indemnification

If someone brings a claim against us because of how you used the service, because you broke these terms, or because you violated the law or someone's rights, you agree to cover our resulting costs, including reasonable legal fees.

11. Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws rules.

Any dispute will be brought in the state or federal courts located in Allegheny County, Pennsylvania, and you agree those courts have jurisdiction over you.

12. Changes

We may update these terms. When we do, we'll change the effective date at the top, and for significant changes we'll email waitlist members or post a notice on the site.

Continuing to use the service after changes take effect means you accept them.

13. If part of this doesn't hold up

If any part of these terms is found unenforceable, the rest stays in effect.
